The Essence of Clarity is an Organisation helping Individuals who want to learn how to declutter and organize their personal and work related spaces. These terms are conditions are an extension of our website Terms and Conditions and apply to face-to-face services and consultations by The Essence of Clarity employees, owners and / or directors.

Payments

All payments for the private consultation are to be made in Australian Dollars (AUD). 

The 30 Day Guarantee applies to our services if you can prove no work has been commence as per original agreement. To claim the Guarantee, purchasers must email info@theessenceofclarity.com.au within the first 30 days with a clear reason for the return.

Success in Organizing and Decluttering is entirely dependent on the person participating in our efforts, services, ideas and techniques.

Your level of success in attaining the results claimed in our materials depends on the time you devote to organizing and decluttering, our ideas and techniques mentioned, your finances, knowledge and various skills, not the least the speed at which decisions are made and a proactive approach to instructions is followed.  Since these factors differ according to individuals, we cannot guarantee your success.  Nor are we responsible for any of your actions.

Except for any liability in relation to a Non Excludable Condition, we exclude all liability whether arising in tort (including, without limitation, negligence), contract, equity or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the services. Nothing in these terms affects the statutory rights of any person under the Australian Consumer Law or any other applicable law.

You agree that we will not be liable for any loss or damage which you incur as a result of use of this website including without limitation, damage caused by access delays, computer viruses, system failure or malfunction which may occur in your use of the website including hyperlink to or from third party websites.

The Essence of Clarity is committed to the protection of personal information provided to us. Our Website follows various principles concerning the collection, storage and use of personal information as contained in the Australian Privacy Principals contained in Privacy Act (1988)(Cth). Indemnification

You agree to indemnify and hold harmless The Essence of Clarity, any affiliated organisations, and its directors, officers and employees from any claim or demand including reasonable legal fees, made by any third party due to or arising out of your use of this site or any violation of these Terms and Conditions.

Offer of Products or Services

Once contact has been made and a date has been set for an appointment this is a binding contract. We have a 48- hours cancellation Policy and will retain the right to recoup full cost if a cancellation is made after this period. Every effort will be made to contact you in the days leading up to our appointment to confirm.

Payment agreements

You agree to make a payment within 7 days of receiving our invoice. In the event that payment has not been made within the 7 days period on previous occasions. We ask you to pay our service fee in full up front. Payment is charged on an hourly and minute by minute basis and a travelling fee could apply. Our total fees include GST.

Insurances

The Essence of Clarity holds a valid up to date Insurance Policy and will have all workers covered under worker’s compensation. Although the insurances are in place we do not take responsibility for breakages or damage to your property and / or possession. The nature of organising and decluttering work means there is a risk of damage to property and / or possession and even though great care will be taken by us, you are entering into an agreement with full awareness of this risk.

Applicable Law

These Terms and Conditions shall be construed and governed by the laws of New South Wales, Australia. Further, any dispute arising from these Terms and Conditions or a breach of any agreement between us and you will be governed by the laws of New South Wales, Australia. As a user of this website and our services you submit to the exclusive jurisdiction of the courts of New South Wales, Australia and the federal courts of Australia.
